Appliance Parts North — Seller Terms
Appliance Parts North (“APN”, “we”) is a marketplace for appliance parts operated by ELECTROFIABLE inc. (Québec, Canada) at https://appliancepartsnorth.ca. These Seller Terms govern the use of APN by anyone who offers parts for sale (“Seller”, “you”). They are completed by the Offer Policy, the Condition & Compatibility Disclosures, the Photos & User Content Policy, and your own return policy on file. The site’s Marketplace Terms (accepted by every account at registration) also apply. The Privacy Policy is a separate notice acknowledged at registration; it is not part of this contract, and any specific privacy consent (for example, opting in to public phone display) is collected separately.
1. Scope and acceptance
1.1 These Seller Terms apply to every Offer you create, submit, or keep active on APN, in English or French.
1.2 You accept these Seller Terms during seller onboarding, before your seller account is activated. Acceptance is an explicit act, not a pre-ticked box. APN records the version accepted, your account identifier, and the date and time of acceptance.
1.3 Acceptance of the current version of these Seller Terms is a condition for submitting, promoting, activating and resuming Offers. When APN publishes a material new version, this condition closes again until you accept the new version: you may not submit, promote, activate or resume Offers until you do. Offers that are already active remain active in the meantime, and your dashboard shows the state and the action required. Refusing the new version means you cannot perform those actions; you may still pause, archive or remove your Offers.
1.4 Each time you submit an Offer, you also confirm an accuracy attestation for that specific submission. That attestation is recorded with the submission.
2. Account and identity
2.1 One APN account serves as both buyer and seller account; selling is an extension of the same account. You may hold only one account and one seller profile.
2.2 To sell, you complete the seller onboarding on your account: verify your account e-mail address, complete a seller profile with a unique public seller name, verify a phone number, and accept these Seller Terms. Once every step is complete, your seller account is activated automatically. Before your first Offer you must also keep a return policy on file.
2.3 Your account e-mail address is set at account creation, is unique to your account, and is permanent: it cannot be changed through your account settings. Contact APN support if your situation genuinely requires an exception.
2.4 Your verified phone number can be replaced only by verifying the replacement number; until the replacement is verified, your current verified number remains in force. A phone number can belong to only one APN account at a time.
2.5 Your legal name, seller type (individual or business), verified phone number, billing identifiers, and plan are private. APN displays only your public seller name, your city and region/province, and your availability status.
2.6 Your verified phone number stays private unless you explicitly opt in to display it. You may withdraw that opt-in at any time. Replacing your phone number never changes that choice by itself.
2.7 You are responsible for keeping your account credentials secure and for all activity under your account. You must keep your identity, contact and phone details current and truthful.
2.8 If you sell as a business, consumer protection legislation (including the Québec Consumer Protection Act) may apply to your sales. You are responsible for your own compliance with the laws that apply to you.
3. Inventory ownership and control
3.1 You may only offer parts that you own or lawfully control and are entitled to sell. You may not offer parts held by a third party, drop-shipped from another marketplace, or otherwise not in your possession or lawful control.
3.2 You must be able to fulfil each active Offer at the quantity shown.
4. Offer accuracy and APN Parts
4.1 Every Offer is attached to an APN Part, which is APN’s own catalog record. APN Parts are created and maintained by APN. You never edit an APN Part; APN owns its page structure, title and search presentation.
4.2 A part reference you enter is never presumed to be an original manufacturer (OEM) reference. Verification of a reference is APN metadata, not a Seller claim, and gives no assurance about your specific item.
4.3 You must declare origin truthfully: OEM or compatible. A compatible part is never to be described as OEM. Only the offer types listed in the Offer Policy may be created.
4.4 You may hold only one active Offer per APN Part per condition/origin/test combination. Duplicate Offers may be refused, merged, or suspended.
4.5 You must not claim that a part fits a specific appliance model unless you can support that claim. An APN Part reference is not a guarantee of fitment for any given appliance.
5. Condition, testing, warranty and returns
5.1 You must disclose condition accurately (new, open-box, used) and any defect, missing element, or wear.
5.2 A used OEM part must be declared tested and working, and you must describe how you tested it. “Tested” never means universal compatibility.
5.3 You must state either a commercial warranty (with its terms) or “no commercial warranty”. APN does not set commercial warranty durations; the choice is yours. Choosing “no commercial warranty” never removes or reduces any legal warranty or other right that applicable law grants the buyer, and you must never claim otherwise. Every warranty statement must be truthful and honoured. Paid extended warranties are out of scope of this version of APN.
5.4 You must keep a return policy on file before your first Offer. Each version is stored immutably; the version in force at the time of a sale applies to that sale. Your return policy must be consistent with APN’s platform-level service standards (section 5.6) and with applicable law.
5.5 Mandatory rights come first. Where applicable law grants the buyer rights or deadlines (for example the Québec Consumer Protection Act, the legal warranty of the Civil Code of Québec, distance-contract rules), those rights apply as such. Nothing in these Terms, in your return policy, or in APN’s service standards limits or reduces them.
5.6 APN service standards (subject to applicable law). The following are APN’s business defaults; they never shorten a mandatory right:
- Response to a buyer claim: target within 2 business days.
- Handling and shipping: you dispatch within the handling time you selected on the Offer — 1, 2 or 3 business days, shown to buyers as “Ships within N business days”. This is the delay before carrier hand-off; carrier transit time is additional and no delivery date is promised.
- Escalation to APN: if you have not responded to a claim within 5 business days, the buyer may escalate to APN and APN may intervene.
- Seller error, wrong item, description error: return costs are borne by you where applicable.
- Buyer remorse (change of mind): handled under your own return policy, plus any mandatory right the buyer holds under applicable law.
- Refunds: processed promptly through the APN workflow and always within any mandatory deadline.
- Commercial warranty: as declared in the Offer (section 5.3).
5.7 What you bear financially. Subject to applicable law: where you use APN Shipping, the real cost of the outbound label APN buys is charged to you; the cost of a return is yours on any accepted return and not only where you are at fault, whether it travels on an APN return label charged to you or on a carrier you pay directly; payment processing fees that are genuinely not recoverable from the payment provider remain at your charge; and on a conforming return APN returns its 10 % commission to you while the fixed platform fee of 1.00 CAD is retained. Your settlement is consolidated: where the amounts owed on a settlement cycle exceed the amounts payable to you, the balance is carried forward and offset against your next payout rather than producing a negative payout. Payouts are made twice a month, on the 15th and on the last day of the month.
6. Quantity and inventory accuracy
6.1 Quantity shown must reflect real stock. Update or pause Offers as soon as stock changes. Repeated cancellations for lack of stock are a policy breach.
7. Photos and content rights
7.1 Photos must show the actual part you are selling; for open-box and used parts, real photos are mandatory. See the Photos & User Content Policy.
7.2 You warrant that you hold the rights to all text and images you upload. You grant APN a non-exclusive, worldwide, royalty-free licence to host, display, resize, convert, and cache that content on APN and in its Offer and Part pages, search results and communications, for as long as the content or the related Offer is retained.
8. Shipping and packaging
8.1 At launch, every purchasable Offer is fulfilled by shipping only. Pickup is not available: an Offer configured for pickup, or for shipping and pickup, is not purchasable and is shown to buyers as “Not available for shipping”. Each Offer states its packaged weight (required); packaged dimensions are optional. The Platform computes live Canada Post shipping rates from your private origin postal code and the Offer’s packaged weight, and the buyer pays shipping at checkout: you do not set the shipping price and you do not choose the carrier. You select a handling time for each Offer — 1, 2 or 3 business days — shown to buyers as “Ships within N business days”; this is the delay before carrier hand-off, carrier transit time is additional, and no delivery date is promised. You are responsible for packaging suited to the part and for dispatch within your announced handling time. When you ship, you mark the vendor order shipped in your seller dashboard with its tracking number (required; providing the carrier label is optional). The buyer sees shipment status and tracking on their order page and receives a shipment e-mail.
8.2 Only your city and region/province are shown publicly. Your origin postal code is private: the Platform uses it only to compute shipping rates and never displays it.
9. Customer service and communications
9.1 You must respond to buyer questions in a reasonable time and act in good faith to resolve issues. For claims after a sale, the APN service standards of section 5.6 apply (target response within 2 business days; escalation to APN possible after 5 business days without a response), subject to applicable law.
9.2 Your availability status shows whether you accept chat and/or calls. Outside “Away”, at least one of chat or call must remain enabled. “Away” (vacation mode) means temporary unavailability: your inventory is kept, but your Offers are not presented as available. Please set “Away” whenever you cannot fulfil.
9.3 Communications with buyers must remain courteous and on topic.
10. Plans, subscription obligations and commission
10.1 Plans: STARTER (free, 10 active Offers), SELLER (14.99 CAD/month, 100 active Offers), PRO (29.99 CAD/month, 600 active Offers). Billing is monthly, no trial, cancellation takes effect at the end of the current period, no refunds in this version. Prices are before applicable taxes.
10.2 Payment is processed through Stripe hosted Checkout and Portal. APN never stores your card details.
10.3 If a payment fails, you have a 14-day grace period. After that, your account floors to STARTER: active Offers above the STARTER limit are automatically suspended, newest activated first, and are never deleted. They can be resumed when capacity is restored.
10.4 No plan buys any ranking, moderation, or visibility advantage. ELECTROFIABLE inc., as a seller, follows exactly the same rules as any other Seller.
10.5 Commission on sales. APN charges you a commission on each sale made through the Platform: 10% + $1 CAD per sale. This commission includes Stripe payment-processing fees; you are never charged Stripe processing fees separately.
11. Moderation and corrections
11.1 Moderation is automatic by default and human by exception. An Offer with a resolved reference, valid data and no exception is approved automatically and activated where capacity allows.
11.2 Human review occurs only for exceptions: ambiguous reference, data conflict, requested correction, reports or suspected abuse. Never solely because of the offer type, condition, test status or age of a part.
11.3 APN may ask you to correct an Offer (“Needs correction”). Until corrected, the Offer is not active.
11.4 Changes after promotion. Once an Offer has been promoted, changes fall into three classes (details in the Offer Policy):
- Class A — immediate, no human review: price, quantity, seller SKU, non-substantial descriptions and narratives (key selling points, additional description, installation tips), public approximate location (city/region), and adding photos. Normal validation, ownership checks, versioning and existing gates still apply.
- Class B — same Offer, automatic re-review: test status, test method or explanation, warranty (declared or not, and its details), known defects, donor appliance or model, replacing or removing photos, and any other substantial buyer-facing change. On the clean path (no exception detected) there is no human review; a real exception triggers the review or “Needs correction” workflow. An Offer always keeps at least one real photo.
- Class C — structural, not editable: APN Part, origin (OEM/compatible) and condition (new/open-box/used). To change any of them, archive the Offer and create a new one.
12. Suspension and termination
12.1 APN may suspend or archive an Offer, or suspend or terminate your seller authorization, for breach of these Terms or the referenced policies, misleading claims, abuse, or lawful request. Capacity suspensions (section 10.3) are automatic and reversible.
12.2 You may pause, archive or remove your own Offers at any time and may stop selling by cancelling your plan at period end.
12.3 Graduated enforcement. Except in the cases of section 12.4, APN applies measures in proportion to the breach, states its reasons, notifies you, and gives you a chance to respond, following this ladder: (1) warning; (2) correction required; (3) forced pause of the Offer(s) concerned; (4) suspension of your seller authorization; (5) termination of your seller authorization. Repeated breaches move up the ladder.
12.4 Immediate measures. In case of fraud, safety issues, serious abuse, or conduct presenting a significant risk (for example counterfeit goods, dangerous or recalled parts, identity misuse, payment circumvention, harassment, disclosure of others’ personal data, or repeated abuse), APN may move directly to an immediate suspension or any other appropriate measure, with notice and an opportunity to respond afterwards.
12.5 ELECTROFIABLE inc., as a seller on APN, is subject to exactly the same enforcement rules.
13. Prohibited behaviour
You must not: misrepresent origin, condition, testing or warranty; offer counterfeit, stolen, dangerous or recalled goods; use another person’s photos or content without rights; harass buyers or other sellers; send spam; steer buyers to pay outside APN or otherwise circumvent APN payment; disclose anyone’s private information; manipulate reviews or reports; or circumvent plan limits with multiple accounts.
14. Changes to these Terms
14.1 These Terms carry an integer version number. APN keeps an archived, unchangeable copy of every published version so that the exact text you accepted can always be identified.
14.2 A material change produces a new version number and requires your re-acceptance under section 1.3 before your next Submit, Promote, Activate or Resume. A purely editorial change (wording, typos, formatting, cross-references) does not change the version number; only the “last updated” date changes.
14.3 Every acceptance is recorded with the exact version accepted.
15. Governing law and disputes
These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein. Any dispute relating to these Terms is submitted to the courts of the Province of Québec, except where a provision of mandatory law grants you the right to another forum or another recourse — nothing in this section limits any mandatory right you hold, including any non-waivable right under consumer protection legislation.
